1. Acceptance of Terms
By accessing or using Yogaanvesha (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Platform.
2. Platform Use
Yogaanvesha is an independent discovery marketplace. We connect seekers with yoga schools, teachers, and retreat organizers ("Schools"). We are not a school, teacher, retreat operator, travel agent, or insurer. Any booking is a direct agreement between the seeker and the School.
We curate listings, verify schools where possible, publish honest reviews, and facilitate payments, but the practice, instruction, accommodation, and on-site experience are provided by the School.
3. Accounts & Eligibility
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- Provide accurate, current information. Impersonation or falsified credentials may lead to termination.
4. Seeker Responsibilities
- Review each School's description, schedule, inclusions, cancellation policy, and requirements before booking.
- Disclose any medical conditions, injuries, or restrictions to the School and consult a healthcare professional if unsure whether a practice is appropriate for you.
- Arrange your own travel, visas, insurance, and personal safety measures. We recommend comprehensive travel and medical insurance.
- Behave respectfully toward teachers, staff, and fellow students, and follow the School's on-site rules.
5. School & Host Responsibilities
- Provide accurate listings, pricing, dates, inclusions, and photos. Misleading content may be removed.
- Hold appropriate teaching qualifications, permits, insurance, and licenses required in your jurisdiction.
- Honor confirmed bookings and communicate promptly with seekers.
- Publish a clear cancellation and refund policy, and process refunds in accordance with these Terms and your stated policy.
- Maintain a safe environment and comply with all applicable health, safety, and consumer-protection laws.
6. Bookings & Payments
Bookings are made through the Platform using our payment processor. A booking is confirmed once payment is successful and you receive a confirmation email. Prices are shown in the listing currency and may include platform fees and applicable taxes.
You authorize us and our payment processor to charge your selected payment method for the total booking amount. Where the School sets a deposit or balance schedule, that schedule will be disclosed at checkout.
7. Cancellations & Refunds
Unless a listing states otherwise, our standard cancellation policy is:
- 30+ days before start date: 100% refund of the booking amount, less non-refundable payment-processor fees.
- 14–29 days before start date: 50% refund.
- Fewer than 14 days: No refund, except at the School's discretion.
Refunds are issued to the original payment method and may take 5–10 business days to appear. If a School cancels a confirmed booking, seekers are entitled to a full refund of amounts paid through the Platform.
Force-majeure events (natural disasters, government restrictions, serious illness) are handled case-by-case in good faith.
8. Reviews & User Content
You retain ownership of content you submit (reviews, photos, messages) and grant Yogaanvesha a worldwide, royalty-free license to host, display, and distribute it in connection with the Platform. Reviews must be honest, based on genuine experience, and free of defamatory, discriminatory, or unlawful content. We may remove content that violates these Terms or our Review Ethics policy.
9. Intellectual Property
The Yogaanvesha name, logo, design system, editorial content, and software are owned by Yogaanvesha and protected by intellectual property laws. You may not copy, scrape, or redistribute Platform content without written permission.
10. Prohibited Conduct
- Fraudulent bookings, chargeback abuse, or payment circumvention.
- Off-platform solicitation to avoid fees after a Platform introduction.
- Harassment, hate speech, or unlawful discrimination.
- Automated scraping, reverse engineering, or security probing.
- Posting fake reviews or manipulating ratings.
11. Disclaimers & Assumption of Risk
Yoga and related practices carry inherent physical risks. You participate voluntarily and at your own risk. The Platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings are error-free or that the Platform will be uninterrupted.
12. Limitation of Liability
To the maximum extent permitted by law, Yogaanvesha and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the Platform or any booking. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid to Yogaanvesha in the twelve months before the claim, or (b) USD 100.
13. Indemnification
You agree to indemnify and hold harmless Yogaanvesha, its affiliates, and their officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Platform, your content, or your breach of these Terms.
14. Termination
We may suspend or terminate your access at any time for violation of these Terms, suspected fraud, or to protect other users. You may close your account at any time from your account settings. Provisions that by their nature should survive termination (payment, liability, dispute resolution) will continue to apply.
15. Dispute Resolution & Governing Law
Informal resolution first. Before filing any formal claim, please contact us at support@yogaanvesha.com so we can try to resolve the matter within 30 days.
Binding arbitration. Any dispute that cannot be resolved informally will be settled by binding arbitration on an individual basis under the rules of a recognized arbitration body in the jurisdiction of Yogaanvesha's principal place of business. You waive the right to participate in a class action.
Governing law. These Terms are governed by the laws of the jurisdiction in which Yogaanvesha is established, without regard to conflict-of-laws principles. Nothing in this section limits any non-waivable consumer rights available to you under local law.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the Platform or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.
